EVENT CANCELLATION, DAMAGE AND WEATHER WAIVER
("CDW").
CDW
is a limited wavier to help protect against cost, loss
and damages to AEG equipment and services for weather or any
reason except intentional abuse, negligence or default and also
limits costs should the event contract need to be cancelled a
few days before setup begins. The
waiver is not liability insurance and does not protect the
assets of others or against injury to others. The waiver also
provides the ability to CASHOUT (sell) a future event E-CREDIT
or E-CERTIFICATE to
AEG to receive cash back.
THE CDW WAIVER IS ONLY AVAILABLE FOR ALL ITEMS IN A
CONTRACT, NOT JUST ON CERTAIN PARTS OF ONE. |
Two options exist:
The FULL CDW waiver and the LIMITED CDW waiver.
The FULL CDW provides the most inclusive benefits must be purchased 20-days
or more before the EVENT START DATE but pricing is lower if
purchased more than 45-days in advance.
The
LIMITED CDW provides CASHOUT benefits only and must be purchased
within 30-days AFTER the EVENT START DATE. CDW purchases made
less than 20-days before the EVENT START DATE are LIMITED CDW
only.
The cost of either
CDW option is
the same, varies with contract size and can be found near the
bottom of your Event Order (EO) contract. CDW cost cannot
be decreased or cancelled once purchased, although cost will
increase if your EO later increases.
FULL WAIVER BENEFITS.
The CANCELLATION benefit is limited and
provides protection against event cancellation for any reason
prior to 72-hours before the TURN-OVER TIME shown on your
contract or BEFORE setup begins, whichever is earlier. Outside
this period, the unused
portion of the rental "taxable basis", less any offsets, as
shown in your event order is adjustable by ECREDIT only.
Non-refundable and non-adjustable costs include: (a) labor
expended, (b) the MAINTENANCE BASIS of the rental, (c) DELIVERY
costs, (d) custom items, (e) insurance and wavier costs, and (f) purchases. For
refundable or adjustable items a 20% deductible (or cancellation cost)
applies. No
reason is required when the waiver is in
effect.
The DAMAGE and WEATHER benefits protect against loss and
damages to AEG equipment while in use. It waives portions of the
costs associated with damage, theft and loss to AEG equipment
during USER’s rental provided damage is not due to the
intentional act, negligence or failure of DUE DILIGENCE of
USER, AGENT(s) of USER or USER's PARTICIPANTS. Because equipment replacement costs are up
to 12-times the daily rental, CDW purchase is
highly recommended, but still optional. By purchasing the CDW, loss and
damages are capped at 20% (expended costs such as insurance and
contract prep are excluded). But only
the first loss of an item during a rental
period is covered and the waiver expires on the original
(unextended) rental end date. CDW can be extended if a contract
rental period is extended, however, this is not automatic and it
not part of the extended rental fee. CDW waiver extensions must
be shown as a separate contract line item in the revised
(extended) contract.
YOU MUST HAVE THE CDW WAIVER TO "CASHOUT" AN
E-CREDIT OR E-CERTIFICATE, OTHERWISE YOU
CAN USE IT IN THE NEXT 15-MONTHS, TRANSFER IT
TO ANOTHER OR SELL IT TO ANOTHER. |
CASHOUT OPTION. No deductible applies to the CASHOUT amount when
the FULL CDW is in effect, but the 20% deductible on items
covered does apply. A 20% deductible applies to the CASHOUT
amount when only the LIMITED CDW is in effect. To be
eligible for CASHOUT the items for which an E-CREDIT or
E-CERTIFICATE was issued must have been covered when CDW
was purchased or have later been added to it (additional
cost).
SINGLE CLAIM ALLOWED. Only one damage or weather claim is
allowed per CDW purchase. The purchase of a second CDW is
needed to maintain coverage on long term rentals once a claim is
made.
Without CDW: USER is solely responsible for all costs
to AEG assets for any reason, including but not limited to:
weather, theft, vandalism, misuse, act of God, disease,
government action, terrorism and emergency.
USER is always responsible for returning PROPERTY in same
condition as delivered regardless of use, delay, additional use
or any other reason. USER's account must be timely paid to use
the waiver and the waiver shall be void in case of USER DEFAULT.
There is no coverage: (a) on any USER PROPERTY used in, with or
on AEG's PROPERTY; (b) on ESITE or PARTICIPANTS and (c) on or
for consequential, subsequent or liability damages. Claims must
be submitted in writing within 20 days of occurrence.
SELECT EVENT SERVICE provides pre-selection of only the best
items in inventory with special cleaning, touch-up and detailing
so the best possible presentation, as close as possible to new,
is made. Normal rental inventory is maintained in good
condition, however, it is used and only the viewable end product
is typically considered.
A PRE-EVENT SITE INSPECTION VISIT provides assistance to
determine the specific needs of your event site. This is
important when landscaping, level, available space, utilities
and other conditions may impact potential use. Seeing the actual
site can also give designers the opportunity to imagine
everything possible for it. A PRE-ORDER SS REVIEW assists in
determining the structural and safety needs for an event. This
is important when special or prolonged use is anticipated.
EXCLUDED CLAIMS include those for which the user or injured
party is determined responsible such as intentional dangerous
acts, willful misconduct and acts not in compliance with safe
use policy or posted signage. We recommend a RELEASE SIGN be
posted at all entrances and/or a RELEASE WAIVER be signed by all
participants of ride, game, cooking and higher risk activities.
Excess claims would be those exceeding the policy limits. Policy
limits are set high so that excess claims are not a significant
possibility.
